The Constitutional Court of the Russian Federation has approved a strict approach to the confiscation of assets related to corruption crimes, write “Knowledge”.
Previously, capital prosecutor Maxim Zhuk reported that losses due to corruption crimes in Moscow this year amounted to nearly 1 billion rubles. The prosecutor's office confiscated assets acquired with unconfirmed income in the amount of 468 million rubles.
According to the newspaper, the Constitutional Court allows the confiscation of assets of third parties, including relatives who are not directly involved in corruption but know about the criminal conspiracy.
As determined by the court, accepting bribes does not imply the legal appearance of property rights. For this reason, “the object of bribery cannot be delivered to the bribe recipient or the person to whom the bribe is transferred at the direction of the bribe recipient.”
The Constitutional Court clarified that this also applies to single-family homes.
Election lawyer, executive director of the Genesis Foundation for Social Innovation in Civil Society Oleg Zakharov explained that the Constitutional Court has always upheld the legal opinion that the constitutional goal of the fight against corruption allows us to deviate from the general rules of civil circulation of real estate.
